By accessing or using the Site, you represent and warrant that you have read, understood, and agree to be bound by these Terms. You also represent that you have the legal capacity to enter into this agreement.

While account creation may not be required to use all features of the Site, if account creation is offered in the future, the following terms will apply:

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.  
  • Account Termination: We reserve the right to terminate or suspend your account at any time, for any reason, including but not limited to violation of these Terms.  

3. User Conduct

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site. Prohibited conduct includes, but is not limited to:  

  • Posting or transmitting any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.  
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.  
  • Uploading, posting, or transmitting any content that you do not have a right to transmit under any law or contractual relationship.  
  • Uploading, posting, or transmitting any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

User-Generated Content: If the Site allows users to submit content (e.g., job postings, comments), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or have the necessary rights to submit such content and that the content is accurate and does not violate these Terms or any applicable laws.

  • No Warranty: THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  
  • Accuracy of Information: We make no warranty regarding the accuracy, timeliness, completeness, or reliability of any information on the Site, including job postings and user-submitted content. We are not responsible for any errors or omissions in such information.
  • Third-Party Links: The Site may contain links to third-party websites. These links are provided for your convenience only and do not constitute an endorsement by us of the content of such websites. We are not responsible for the content of linked third-party sites.  
  • No Guarantee of Employment: Use of the Site does not guarantee that you will find employment or that employers will find suitable candidates.
  • Employer/Job Seeker Responsibility: We are not responsible for the hiring decisions made by employers or the information provided by job seekers.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HENRY HIRE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account (if applicable). All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.  

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.  

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association in Washington State. You waive the right to participate in any class-action suit.
